§ 54-6. Management and monitoring program.

  • (a)

    Generally. To ensure proper planning for adequate public facilities concurrent with the impacts of development, the town shall establish and maintain management and monitoring practices to:

    (1)

    Adequately plan for and fund public facilities; and

    (2)

    Evaluate the capacity of public facilities for use in the regulatory program to ensure that no development orders are issued unless adequate public facilities are available concurrent with the impacts of development or that no development orders are issued unless they are conditioned on the availability of public facilities concurrent with development impacts.

    (b)

    Annual public facilities update report. By March 1 of each year, the local planning agency shall complete and submit to the town commission an annual public facilities update report for the period ending September 30 of the previous year. The annual public facilities update report shall summarize the available capacity of public facilities based on their level of service, and forecast the capacity of existing public facilities and planned capital improvements identified in the five-year capital improvement schedule for each of the five succeeding years. The forecasts shall be based on the most recently available schedule of capital improvements for each public facility. The annual public facilities update report shall also revise population estimates and projections, update public facility inventories, update unit costs, and update revenue forecasts, as necessary for inclusion within the capital improvements element. The findings of the annual public facilities update report shall form the basis for any proposed amendments to the capital improvement element, any proposed amendments to the town's annual budget for public facilities, and the review of and issuance of development orders during the next fiscal year. Until the initial annual public facilities update report is prepared, data and analyses within the comprehensive plan shall be used for the purposes specified in this subsection.

    (c)

    Recommendations on amendments to capital improvements element and annual budget. Based upon an analysis of the annual public facilities update report, the local planning agency shall propose to the town commission, each year, any necessary amendments to the capital improvement element, and any proposed amendments to the town's annual budget for public facilities.
