§ 38-4. Prohibited activities on bridges.

  • (a)

    Findings. It is hereby declared to be the legislative intent of the town commission that bridges erected on public property are intended to facilitate the transportation of vehicles and walking pedestrians and any use other than transportation threatens the private property rights of surrounding landowners and endangers the lives of all concerned.

    (b)

    Prohibited acts. It shall be unlawful for any person to swim, dive, fish, or net from, on or about any public bridge located within the territorial limits of the town. These restrictions shall not apply to any bridges maintained by the state department of transportation.

    (c)

    Signs. On all bridges to which this section applies, signs shall be erected setting forth substantially the following information:

    Danger
    No Swimming, Diving, Fishing at This Bridge
    Surrounding Property Is Privately Owned—Trespassing Is Prohibited

    Violations of this section shall be a Class A violation, punishable as set forth in chapter 18.
