§ 2-324. Presentations by public; conduct; rules of order.

  • (a)

    Any person desiring to address a town board from the floor regarding a specific matter on the agenda, or to present a matter under the agenda item for presentations from the public, shall complete and submit a form to identify the speaker and the matter to be addressed. The form shall be provided by and submitted to the town clerk or the recording secretary before commencement of the address. A person desiring to address a town board from the floor on a matter brought up for discussion by another person under the agenda items for presentations from members of the town board or presentations from the public shall not be required to complete a form.

    (b)

    Each person addressing the town board from the floor shall await recognition by the presiding officer and shall step forward to the lectern or microphone and give his name for the record before commencing. Addresses from the floor shall be restricted to the subject of the matter under discussion and shall be limited to three minutes for each speaker on each matter. Before an agenda matter is presented, the limitations as to duration and frequency of addresses from the floor may be waived upon the vote of the town board. The limitations as to duration and frequency shall not apply to an interested party.

    (c)

    No action or inaction taken by a town board shall be void or voidable by virtue of any inadvertent or intentional departure from the procedures provided under this article.

    (d)

    Any person addressing a town board or attending a town board meeting who continues, after an oral warning from the presiding officer, to disrupt the orderly and efficient conduct of the meeting by failing or refusing to comply with this article through boisterous or unruly behavior, or to threaten or incite an immediate breach of the peace, or to use profane or obscene speech, may be removed from the meeting room at the direction of the presiding officer for the duration of the meeting or for a lesser time as the town board shall determine. The decision of the presiding officer shall be subject to immediate appeal by any sitting member of the town board and may be reversed by a vote of the town board.

    (e)

    All meetings shall be conducted as described by Robert's Rules of Order, Newly Revised, with reference to the conducting of public meetings.
