§ 2-206. Primary elections; tie votes.

  • (a)

    The candidates for nomination to the office of town commission who shall receive the greatest vote in the primary election shall be placed upon the ballot at the next regular municipal election in number not exceeding twice the number of vacancies in the town commission to be filled, and the candidate at the regular municipal election not exceeding the number of places to be filled who shall receive the greatest number of votes at such regular municipal election shall be declared elected.

    (b)

    A tie between two or more candidates for the town commission shall be decided by lot, to be conducted by the town attorney. When a number of candidates for the office shall not exceed twice the number of vacancies existing in the office, then no primary shall be held and the town commission shall declare such candidate as nominated for the office of town commission at the regular municipal election. However, if there are more than twice the number of candidates than vacancies for such office, then it shall be the duty of the town commission to hold a primary election as provided in this section.
