§ 2-101. Established; membership; term of members.

  • (a)

    There shall be a board known as the board of zoning adjustment, which shall consist of five members appointed by the town commission.

    (b)

    The town commission shall also appoint two alternate members of the board of zoning adjustment to serve at the request of the chair of the board of zoning adjustment if any regularly appointed member of the board of adjustment is unable to attend a meeting of the board.

    (c)

    No regular member of the board of zoning adjustment or an alternate of the board of zoning adjustment shall be appointed who holds an elective public office or is a public employee or a public official, except in his capacity as a member of the board of zoning adjustment, and, further, such regular or alternate member of the board of zoning adjustment must be a resident of the town.

    (d)

    Members of the board of zoning adjustment shall serve for overlapping terms of three years, or thereafter until their successors are appointed. Not more than a minority of the terms of such members shall expire in any one year.

    (e)

    Vacancies for the unexpired term of any member of the board shall be filled by the town commission.
