§ 22-174. Recovery of costs incurred by town.

(a)

Any person causing or allowing a release shall reimburse the town for the full amount of its costs within 30 days after receiving an invoice from the town.

(b)

Any person causing or allowing release of hazardous substances or hazardous waste who fails to timely reimburse the town shall pay a surcharge of $100.00 per day for each day that the invoice for the cost remains unpaid, or ten percent of the total amount of the invoice, whichever is greater.

(c)

The remedy provided for in this section shall be supplemental to, and in addition to, all other available remedies at law and equity.

(d)

The town may enforce the provisions of this section through code enforcement proceedings.
