§ 22-171. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Cost means the expenses incurred by the town in connection with investigating, mitigating, minimizing, removing or abating the release of hazardous substances or hazardous waste, including the cost of labor of town personnel or its agents or independent contractors, equipment operation, expendable items including firefighting foam, chemical extinguishing agents, absorbent materials, sand, recovery drums, chemical protective clothing, gloves, and testing equipment, and the legal expenses and costs of action taken by the town, including those to recover the costs.

    Hazardous substance and hazardous waste mean any substance or material in a quantity or form which poses an unreasonable or imminent risk to the life, health, safety or welfare of persons or property within the town, including those substances listed in the National Fire Protection Association's Guide on Hazardous Materials, the EPA's List of Extremely Hazardous Substances, or the Florida Substance List promulgated by the state department of labor and employment security.

    Release means any release, or threat of a release, of a hazardous substance or hazardous waste upon property within the town.
