§ 22-71. Violation penalties.

  • (a)

    Violations of this article shall be a class A violation and shall be punishable as set forth in chapter 18.

    (b)

    A violation of this article may occur without the occasion of the measurements being made as provided herein. Each new measurement of the sound levels, whether or not in the same day or upon the same source of the noise, constitutes a separate violation of this article. The procedure for punishing motor vehicle noise standards shall be as established in F.S. § 316.923, and applicable rules and regulations of the state department of environmental regulation in cooperation with the state department of highway safety and motor vehicles. Nothing contained herein shall be construed to prohibit any person from commencing a civil action against any person who is alleged to be in violation of any provision of this article, nor shall this article be construed to impair any other common law or statutory causes of action, or legal remedies of any person for injury or damage arising from any violation of this article or from other law.
